Could I use my dads upgrade to get a new phone. ?

Last week my moms phone broke. She did not have a upgrade and nether did I. My dad has one. Could I use his upgrade to get me a iPhone and give my mom my old phone. She told me she wants one just like it and I want a iPhone. Then in November my dad could use my moms upgrade to get him a new phone. Could I actually use his upgrade.
